xQc faces criticism from Pokimane and H3H3 following DMCA counterclaim

After putting in a counter-claim in regards to his DMCA strike, xQc is facing some criticism from fellow Twitch streamers such as Pokimane and H3H3.

When xQc received another minor ban by Twitch after watching the Olympics on stream, he also got a DMCA strike. After advising with his lawyer, xQc went on to say he had filed a counterclaim to the DMCA strike, saying that his watching of the Olympics during his stream falls under fair use and that he’ll be taking a stand, much to the dismay of some of his fellow Twitch streamers.

One of the first people to speak out was Ethan Klein from H3H3, who has fought out a fair use suit in the past and has come out victorious, setting a precedent, then in the YouTube landscape. According to H3H3, xQc’s lawyer is screwing him over and setting him up to fail, also admitting that he feels nervous about a potential lawsuit and what the consequences could be for the scene as a whole if it actually goes through.

While reacting to H3H3’s take, Pokimane also chimed in with some criticism of her own. She went on to say there might be some form of conflict of interest happening, again pointing the finger towards xQc’s lawyer, Ryan Morrison (The Video Game Attorney), as he acts as both a lawyer and agent. Morrison himself has gone on to say he expects the IOC to “let this die” and doesn’t expect legal action, however he goes on to say that he’ll defend xQc “no matter how they proceed”.
