FIFA’s Ultimate Team game mode has been under fire for several years now as many condemn it as “gamefied gambling”. The Dutch government’s regulators sanctioned EA in October 2020 to a 500,000€ payment with additional penalties possible. Electronic Arts appealed against the ruling and the judge’s announced their ruling this week.
EA wins appeal
The lawcourt announced their ruling on Wednesday, officially removing the classification of opening and purchasing FIFA Ultimate Team Packs as gambling.
EA’s success is due to the publisher’s argument, that the packs are not a stand-alone game. It is part of the entire FIFA game and therefore a random element, which cannot be traded freely for actual money. Electronic Arts also argued that most of the packs are earned for free through gameplay.
The court’s decision means that the earlier ruling on October 15, 2020 is voided. Therefore the company will not be obliged to pay the fines, which have accumulated up to almost four million Euro at this time.
